1. Purpose of the present Data Privacy Statement
This data privacy statement refers to the handling of personal data of natural persons by Habegger AG, Riedthofstrasse 124, 8105 Regensdorf (hereinafter ‘Habegger’, ‘we’ or ‘us’).

2. Basis of data processing
We process personal data of persons concerned on the basis of various foundation:
- On the basis of contractual relationships entered or initiated (legal basis within the scope of the DSGVO: Art. 6 para. 1 lit. b GDPR);
- Where appropriate, to safeguard Habegger’s legitimate interests (legal basis within the scope of the DSGVO: Art. 6 para. 1 lit. f GDPR). If you have any questions, please contact us;
- To fulfil legal obligations (legal basis within the scope of the GDPR: Art. 6 para. 1 lit. c GDPR); and
- If necessary, on the basis of consent (legal basis within the scope of the GDPR: Art. 6 para. 1 lit. a GDPR).
3. Purpose of the data processing
We process personal data of data subjects for the following purposes:
- For contract initiation, in particular for offers and for negotiation purposes;
- To fulfil contractual obligations and to make use of contractual rights arising from contracts concluded, in particular for the dispatch of ordered products, for processing customer enquiries, for collection purposes, etc.;
- For correspondence in connection with contractual relationships or on the initiative of the person concerned;
- Within the scope of applications for jobs advertised online to carry out the recruiting process;
- For bookkeeping and archiving as well as for compliance with legal requirements;
- For the operation of the Habegger website;
- For advertising purposes and marketing measures, in particular for sending newsletters, for which separate consent may be obtained within the framework of applicable laws;
- To improve our services.
4. Rights of the parties concerned
In connection with the processing of personal data, data subjects are entitled by law to the rights set out below. Please note that their existence and scope may differ in single cases depending on the specifically applicable data protection legislation:
- Information: Data subjects have the right to be informed by Habegger whether or not personal data are processed by them/ which data these are. Informational enquiries may be submitted.
- Correction: If personal data is inaccurate, the data subjects have a legal right to have these corrected.
- Objection: If the processing of personal data is based on Habegger’s legitimate interest, data subjects may object to the processing of their personal data. However, this only the case if you are in such a special situation that your personal interests prevent the processing of your personal data. Obligatory, predominant reasons of Habegger remain reserved here as well. Please also note that data subjects may object to the use of their personal data for direct marketing purposes. The objection does not affect the processing based on other bases.
- Revocation of consent: If the processing of personal data is based on the consent of the data subject, the data subject may withdraw this consent. The revocation of consent does not affect the processing based on other bases. The revocation is only valid for the future.
- Restriction: Under certain conditions, the data subject may request the processing of his/her personal data to be restricted. This may be the case if the accuracy of the data is doubted. Please bear in mind that this may restrict or even make impossible the provision of services by Habegger.
- Data transferability: If provided for by law, the personal data which the data subject has made available to us may, depending on the applicable data protection law, be reclaimed in a common and machine-readable form and – subject to important conflicting interests – may be used further.
- Deletion: The data subject has a legal right to have his/her personal data deleted if these are no longer required for the purpose for which they were collected or in the event of a justified objection. In any case, the use for legally prescribed reasons and for asserting, exercising and defending legal claims is reserved.
- Complaint: We also emphasise that, depending on the applicable data protection law, data subjects may have a legal right of appeal to the data protection authority responsible for them if they do not agree to the handling of their personal data.
5. Further recipients of personal data
Habegger may use external service providers as contract data processors, in particular for the provision of services or for organisational purposes. Examples are sales partners, external IT service providers, external consultants, external administrative/commercial service providers or other companies belonging to the Habegger AG. Data protection is always guaranteed.
If desired or if this seems necessary or conditioned in the context of a contractual relationship, a complete transfer of personal data to another company within Habegger can also take place.
Furthermore, we reserve the right to share personal data with public authorities for legal reasons or for the enforcement and prosecution of legal claims.
6. Place of data processing
Data processing by Habegger generally takes place in Switzerland or in the country of the Habegger subsidiary entrusted with the specific matter. Personal data may also be disclosed abroad. Notification shall be made in countries with an equivalent standard of data protection or in application of appropriate data protection safeguards or in the light of the data subject’s consent.

7. Duration of the storage of personal data
Personal data of the data subject will be kept for as long as this is necessary for the purpose of processing or as long as Habegger has a justified interest in it. In particular, statutory retention periods for the storage of relevant business documents shall also be authoritative.
